On behalf of DiGi, CIMB Investment Bank Berhad wishes to announce that the Suruhanjaya Komunikasi dan Multimedia Malaysia (“SKMM”) has via its letter dated 5 March 2008 (“Approval Letter”) approved the Proposed Transfer, subject to the following conditions:
(i) Payment is made by TDSB for the penalty imposed as a result of non-compliance of TDSB’s detailed business plan (“Detailed Business Plan”);
(ii) Acceptance by the SKMM of DiGi Telecom’s irrevocable bank guarantee of RM50 million for the balance duration of the Spectrum assignment period; and
(iii) DiGi Telecom is required to comply with the Detailed Business Plan. However, DiGi Telecom is not precluded from submitting variations to the Detailed Business Plan.
